Acceptance of Terms

These Terms of Service ("Agreement") govern the use of SignalWhisperBot ("Service") made available by GDBVL Consulting ("we", "us", or "our"). This Agreement sets forth legally binding terms and conditions for your use of the Service.

By accessing or using the Service in any manner, including, but not limited to, visiting or browsing the Service or contributing content or other materials to the Service, you agree to be bound by this Agreement.

Third-Party Services

To provide the Service, we use the following third-party providers:

• Lemonfox.ai: Audio-to-text transcription
• Stripe: Payment processing
• Loops: Transactional and marketing email delivery
• Amazon SES (AWS): Email delivery via Email Routing feature
• Hetzner Online GmbH: Server infrastructure and database hosting

The use of these third-party services is subject to their own terms of service and privacy policies. We are not responsible for the actions or omissions of these third-party providers.

Intellectual Property

The Service and its original content, features, and functionality are owned by GDBVL Consulting and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limitation of Liability

"As Is" and "As Available" Service

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. GDBVL Consulting does not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Transcriptions will be 100% accurate
• The Service will meet your specific requirements
• Any defects in the Service will be corrected

Disclaimer of Liability

To the maximum extent permitted by applicable law, in no event shall GDBVL Consulting be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to:

• Loss of profits or revenue
• Loss of data
• Loss of business opportunities
• Business interruption

This limitation applies even if GDBVL Consulting has been advised of the possibility of such damages.

Limitation of Amount

In no event shall GDBVL Consulting's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to GDBVL Consulting in the six (6) months preceding the claim.

Acceptable Use

You agree not to use the Service to:

• Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any intellectual property rights of others
• Disrupt or interfere with the Service or servers and networks connected to the Service
• Use the Service for fraudulent or malicious purposes

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Links to Other Sites

Our Service may contain links to third-party sites that are not owned or controlled by GDBVL Consulting.

GDBVL Consulting has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Indemnification

You agree to indemnify, defend, and hold harmless GDBVL Consulting and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including, but not limited to, attorney's fees) arising from:

• Your use of and access to the Service
• Your breach of any term of these Terms
• Your violation of any third-party right, including, without limitation, any copyright, property, or privacy right

Governing Law

This Agreement (and any rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the French courts.

Changes to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of this Agreement is held to be invalid or unenforceable by a court, the remaining provisions of this Agreement will remain in effect.

Waiver

Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.

Entire Agreement

This Agreement constitutes the entire agreement between you and GDBVL Consulting regarding the Service and supersedes all prior agreements and understandings regarding the Service.
